1. Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you" or "your") and Launch Lab Pty Ltd (ABN 11 603 903 868), trading as auspol.ai ("we", "us", or "our"), governing your access to and use of the website at auspol.ai, the auspol.ai application, and all related services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service. We recommend that you print or save a copy of these Terms for your records.
2. Description of Service
auspol.ai provides AI-generated audio content, summaries, and chat-based research tools derived from official Australian parliamentary proceedings (Hansard). The Service includes, but is not limited to:
- Hansard Topic Summaries — personalised AI-generated audio podcasts covering parliamentary debates on topics you select.
- Hansard Podcast — a general AI-generated audio podcast of parliamentary proceedings.
- Hansard Chat — an AI-powered conversational interface for querying parliamentary transcripts.
The content generated by the Service is produced by artificial intelligence and is provided for informational purposes only. It does not constitute legal, political, or professional advice. While we endeavour to ensure accuracy, AI-generated content may contain errors, omissions, or inaccuracies. You should always verify information against official parliamentary records.
3. Eligibility
You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.
4. Account registration
To access certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain and promptly update your account information.
- Keep your login credentials confidential and not share them with any third party.
- Accept responsibility for all activities that occur under your account.
We reserve the right to suspend or terminate your account if any information provided is inaccurate, incomplete, or if we reasonably believe your account is being misused.
5. Fees and payment
The Service operates on a pay-as-you-go model. Creating an account is free. Certain features consume AI tokens that are deducted from your deposited account balance.
- You must deposit funds into your account balance before using token-consuming features.
- Token costs vary depending on the feature used and the complexity of the request.
- All amounts are in Australian dollars (AUD) and are inclusive of GST where applicable.
- Payments are processed by Stripe. By making a payment, you agree to Stripe's terms of service.
- Deposited funds are non-refundable except as required by the Australian Consumer Law.
We reserve the right to change our pricing at any time. Any changes will be communicated in advance and will apply to future deposits and usage only.
6. Intellectual property
All intellectual property rights in the Service, including the website, application, software, design, trademarks, logos, and underlying technology, are owned by or licensed to us. Nothing in these Terms grants you any right, title, or interest in our intellectual property except as expressly set out below.
The underlying parliamentary data (Hansard transcripts) is sourced from official Australian Government records and is subject to Commonwealth copyright and licensing arrangements. Our AI-generated audio content, summaries, and other derivative outputs are produced by us and are subject to the licence and restrictions set out in Section 7.
7. Licence to use content and prohibition on commercial exploitation
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the AI-generated audio content, summaries, and other outputs produced by the Service ("Generated Content") solely for your personal, non-commercial purposes.
Important — No commercial use
You must not, directly or indirectly, use any Generated Content (including, without limitation, audio files, podcast episodes, summaries, or transcripts) for any commercial or revenue-generating purpose. Without limiting the generality of the foregoing, you must not:
- Sell, licence, sublicence, or otherwise commercially distribute any Generated Content.
- Incorporate Generated Content into any product or service that is offered for sale or for which a fee is charged.
- Use Generated Content to generate advertising revenue, including by hosting it on monetised platforms, channels, or feeds.
- Syndicate, repackage, or redistribute Generated Content through any medium for commercial gain.
- Use Generated Content as part of any paid consultancy, advisory, or professional service.
For clarity, you may share Generated Content with colleagues and associates on a non-commercial basis, provided that you attribute the content to auspol.ai. If you wish to use Generated Content for any commercial purpose, you must obtain our prior written consent.
Any breach of this Section 7 constitutes a material breach of these Terms and may result in immediate termination of your account and legal action to recover damages and seek injunctive relief.
8. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable Australian Commonwealth, State, or Territory law.
- Attempt to gain unauthorised access to any part of the Service, other users' accounts, or our systems and networks.
- Interfere with or disrupt the integrity or performance of the Service.
- Use automated tools, bots, scrapers, or similar technology to access or collect data from the Service without our express written permission.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Misrepresent AI-generated content as official parliamentary records or as content authored by a human.
- Use the Service to generate content that is misleading, defamatory, or that infringes the rights of any third party.
9. AI-generated content disclaimer
The Service uses artificial intelligence to generate audio content and summaries from parliamentary transcripts. You acknowledge and agree that:
- AI-generated content may not be perfectly accurate and may contain errors, omissions, or hallucinations.
- Generated Content is not a substitute for reading official Hansard records.
- We do not warrant or guarantee the accuracy, completeness, or reliability of any Generated Content.
- You are solely responsible for any decisions or actions you take in reliance on Generated Content.
10. Availability and modifications
We strive to make the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
11. Limitation of liability
To the maximum extent permitted by law, including the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)):
- The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
- We exclude all liability for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service.
- Our total aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.
12. Indemnification
You agree to indemnify, defend, and hold harmless Launch Lab Pty Ltd, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your breach of these Terms, or your violation of any law or the rights of any third party.
13. Termination
You may terminate your account at any time by contacting us. We may suspend or terminate your access to the Service immediately, without prior notice, if:
- You breach any provision of these Terms, including the prohibition on commercial exploitation in Section 7.
- We are required to do so by law.
- We decide to discontinue the Service or any part of it.
Upon termination, your right to use the Service will immediately cease. Any provisions of these Terms that by their nature should survive termination (including Sections 6, 7, 11, 12, and 15) will continue in full force and effect.
14. Changes to these Terms
We reserve the right to amend these Terms at any time. Where changes are material, we will make reasonable efforts to notify you (for example, by email or by posting a prominent notice on the Service). The updated Terms will be effective from the date of posting. Your continued use of the Service following any changes constitutes your acceptance of the revised Terms.
15. Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales and any courts of appeal therefrom for the resolution of any dispute arising out of or in connection with these Terms or the Service.
16. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be severed and the remaining provisions will continue in full force and effect.
17. Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us in relation to your use of the Service and supersede all prior agreements, representations, and understandings.
